Shipping and Delivery

At this time, Power Chute Design ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, Power Chute Design ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

International

Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. Power Chute Design is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

Sales Tax

Power Chute Design charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being fulfilled.

Return Policy

RETAIL RETURNED GOODS POLICY

  1. Procedure for Returning Items

 

  a) Customers shall obtain return goods authorization (RGA) for returns by calling: (866) 939-4482, mailing a request for RGA to the address under subsection (e) below, or emailing: [email protected] subject line: RGA request. Returns will not be processed without a RGA.

 

  b) Return to: Power Chute Design (see address below) unless otherwise directed herein.

 

  c) Merchandise purchased through wholesaler should be returned to wholesaler instead of to Power Chute Designs.

 

  d) An itemized packing slip, with the information listed below and a RGA must accompany any returned goods.

 

  e) If returning more than one box, each box should contain the RGA number and box number, ie “1/2, 2/2”.

Eligible Products for Return:

 

  1. Received by customer as damaged - Products received damaged may be returned for full credit including domestic freight within the lower 48 United States when reported within three (3) days of receipt by the customer. If product is received damaged, please have the transportation company note “damaged” or “broken” on the freight bill. Damaged products should remain in the original carton for inspection.

 

  2. Received by customer in error - Product shipped in error by Power Chute Design may be returned, for a full credit, including freight, when returned within thirty (30 days) of invoice date. Products must follow RGA instructions.

 

  3. Ordered by customer in error - Products ordered in error may be returned for credit, subject to a 25% restock fee, freight prepaid by customer, when reported within three (3) days of receipt by the customer.

 

  4. Power Chute Design will issue authorization for the return of eligible, unopened product only (no partial containers), subject to limitations of international freight/shipping charges. Except in GA, MS and NC and where mandated by state statute.

 

III.  Non-Returnable Items

 

  a) Merchandise not in the original packaging.

 

  b) Merchandise returned without an RGA or returned more than 60 days after delivery.

 

  c) Merchandise obtained other than through normal channels of distribution or purchased from a source other than an authorized distributor of record of Power Chute Design.

 

  e) Merchandise involved in a fire sale, sacrifice sale, bankruptcy, floor, or earthquake.

 

  f) Items deteriorated or damaged due to conditions beyond the control of the manufacturer or Power Chute Design, such as improper storage, heat, cold, water, smoke, fire, negligence, etc.

 

  g) Non-original or repackaged merchandise.

 

  h) Product sold with specific understanding that it is non-returnable.

 

  i) Merchandise that is obtained in violation of state and federal regulations.

A Certificate of Destruction does not qualify as an acceptable format for product return.

 

Merchandise where the unit package has been opened or the product has been used – excluding damaged or defective products.

 

  1. Transportation/Shipping Charges

Prepaid by customer. No credit will be issued for the administration, shipping, or handling of returns including third party processing fees. (See “Returnable Items” section.) Power Chute Design reserves the exclusive discretion to determine when this policy may be modified or waived..

 

  1. Terms of Return Policy

 

  a) Credit for returned goods of equal value or payment equal to purchase price, at Power Chute Design’s discretion, for Products received damaged, misordered or delivered in error by Power Chute Design, otherwise conforming to the Return Policy.

 

  b) No credit will be issued for administration, shipping or handling, including third party processing fees, without express approval by Power Chute Design.

 

  c) Exclusive of ordering/shipping errors, all merchandise returned is subject to a restocking fee of 25% of purchase price.

 

  d) For items purchased from a wholesaler, credit will be issued through the wholesaler.

 

  e) Returns are subject to final count and acceptance by Power Chute Design, which reserves the right to accept or reject the merchandise for credit pursuant to the policies herein.

 

  f) Power Chute Design reserves the right to destroy, without recourse, all returned packages.

 

  g) Returns should be channeled through the original source of purchase. The original source of purchase is defined as the entity that was directly invoiced by Power Chute Design and the distributor of origin.

 

  h) Unauthorized returns may be destroyed and not reimbursed. Power Chute Design reserves the right to inspect all authorized returns prior to issuing credit or refund and to destroy products deemed unfit for sale whether or not they are eligible for credit.
  1. Title and Risk of Loss:

Title and risk of loss will pass to customer at the time products are delivered to customer. Delivery of all quantities of products shall be deemed to be made in full and in good condition unless Power Chute Design is notified within 3 days from the date of delivery.

VII. Exception:

Power Chute Design reserves the right to make exceptions or changes to this policy due to business necessity and changes in applicable laws and regulations.

You may purchase merchandise from this Web site by using any one of the payment options listed in here. Power Chute Design reserves the right to change its payment procedures at any time without prior notice to you.

VOID WHERE PROHIBITED: Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Power Chute Design and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.

GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of Power Chute Design shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.

MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and Power Chute Design with respect to this Web site. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Power Chute Design with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Power Chute Design.
